Terms of Use

These terms are an agreement between you and Joseph Tech Solutions, the operator of Cal Friend. By creating an account or using the app or the website, you agree to them. Please read them together with our Privacy Policy.
The service
Cal Friend helps you track meals, nutrition, activity and goals, and lets you join groups with friends. We may add, change or remove features over time.
Eligibility and your account
You must be at least 16 years old to use Cal Friend.
Keep your sign-in details safe. You are responsible for activity on your account and for the accuracy of the information you enter. Tell us right away if you think someone else has access to your account.
Not medical advice
Cal Friend provides general information for personal use. It is not a medical device and does not diagnose, treat or prevent any condition.
Talk to a doctor or dietitian before you change your diet or exercise, especially if you are pregnant, have a medical condition or have a history of eating disorders.
AI estimates
Calories, nutrients and workout estimates are generated by models and may be wrong. Review each estimate before you save it.
Do not rely on the app to detect allergens or ingredients you must avoid.
Subscriptions and payment
Some features need a paid subscription bought through Apple. Payment is charged to your Apple account when you confirm the purchase.
Subscriptions renew automatically unless you turn off auto-renew at least 24 hours before the end of the current period. Your account is charged for the renewal within 24 hours before the period ends.
The annual plan includes a one-week free trial if you have not had a free trial of this subscription before. The monthly plan has no free trial. Unless you cancel at least 24 hours before the trial ends, the annual subscription starts and you are charged. Any unused part of a free trial ends when you buy a subscription.
You can manage or cancel your subscription in your Apple account settings. Refunds are handled by Apple under its policies, at reportaproblem.apple.com. Where Family Sharing is available, the buyer and up to five family members can use the subscription.
Your content
You own the content you add, such as photos, logs and messages. You give us a limited licence to store, process and display it only to provide the service to you and to the people you share it with.
If you send a product photo to our food database, you give us a non-exclusive, worldwide, royalty-free licence to use it and show it to other users in Cal Friend. You can ask us to remove it.
Groups and community rules
Be respectful. Do not post content that is abusive, hateful, sexual, violent, illegal or misleading, or that promotes harmful eating. We do not tolerate objectionable content or abusive users.
You can report a message or challenge, and you can leave any group. We review reports and aim to act within 24 hours. We may remove content and suspend or remove accounts that break these rules.
Acceptable use
Do not misuse the service. This includes reverse engineering it (except where the law allows), scraping it, accessing it with automated tools, trying to break its security, impersonating others, or using it in a way that breaks the law or the rights of others.
Our intellectual property
The app, the website, their design and their software belong to us or our licensors. Food data comes partly from public sources, including USDA FoodData Central, Open Food Facts (under the Open Database License) and data.gov.il. Product photos from Open Food Facts (openfoodfacts.org) are available under Creative Commons BY-SA.
We give you a personal, non-transferable and revocable licence to use the app on Apple devices that you own or control, as allowed by the Apple Media Services Terms and Conditions.
Place results are provided by Google Maps, and their use is subject to the Google Maps/Google Earth Additional Terms of Service (https://maps.google.com/help/terms_maps.html) and the Google Privacy Policy (https://policies.google.com/privacy).
Apple terms
These terms are between you and us, not Apple. Apple is not responsible for the app or its content, and has no obligation to provide maintenance or support for it.
If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the extent the law allows, Apple has no other warranty obligation for the app.
Apple is not responsible for any claims relating to the app, including product liability claims, claims that the app fails to meet legal or regulatory requirements, and claims under consumer protection, privacy or similar laws.
If a third party claims that the app infringes its intellectual property rights, we, not Apple, are responsible for the investigation, defence, settlement and discharge of that claim.
You confirm that you are not located in a country that is subject to a US government embargo or that the US government has designated as supporting terrorism, and that you are not on any US government list of prohibited or restricted parties.
You must follow applicable third-party terms when you use the app, such as your mobile data agreement.
Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

Disclaimers
The service is provided “as is” and “as available”. To the extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement, and we do not promise that the service will be uninterrupted or free of errors.
Limitation of liability
To the extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or for loss of data, profits or goodwill. Our total liability for any claim is limited to the greater of the amount you paid for Cal Friend in the 12 months before the claim and USD 100.
Nothing in these terms limits liability that the law does not allow us to limit, such as liability for death or personal injury caused by negligence or for fraud, or your rights as a consumer under mandatory law.
Suspension and ending
You can stop using Cal Friend and delete your account at any time. We may suspend or end your access if you break these terms or if the law requires it.
Deleting your account does not cancel an Apple subscription. Cancel it in your Apple account settings.
Changes to these terms
We may update these terms. If a change is material, we will tell you in the app or by email before it takes effect. If you keep using Cal Friend after that, the new terms apply.
Governing law
These terms are governed by the laws of the State of Israel, and the competent courts in Israel have exclusive jurisdiction.
If you are a consumer in the European Union or the United Kingdom, you also keep the protection of the mandatory laws of your country and may bring claims in your local courts.
Language
These terms are available in several languages. The English and Hebrew versions are the official versions, and if they differ, the English version prevails. Other translations are provided for convenience.
General
If any part of these terms cannot be enforced, the rest stays in effect. If we do not enforce a right, we do not waive it. You may not transfer these terms. We may transfer them as part of a merger or sale of the business.
These terms and the Privacy Policy are the entire agreement between you and us about Cal Friend.
